On 1 January 2020, the Dutch Balanced Labour Market Act (WAB) came into force. This Act aims to make permanent employment less permanent and flex-work less flexible. The good news: under these new laws and regulations, you can still deploy employees on a flexible basis.

If you employ staff through us with an agency contract, you benefit from maximum flexibility and optimal service. You can deploy employees on a flexible basis for as long as 5.5 years. And we are responsible for your duties and risks as an employer.

Wat is an agency contract?

An agency contract is an employment contract between three parties: the employer, the hiring company (you) and the legal employer (Tentoo). The employee works for your organisation, but is on our payroll. As the legal employer, we are responsible for:

  • Salary payments
  • Deduction of social insurance premiums and payroll taxes
  • Pre-financing of salary costs
  • Issuing payslips
  • Absence management
  • Continued salary payments for employees on sick leave

Exclusiveness and allocation

If you deploy a worker with an agency contract, they may not be made available solely to your organisation. A flex-worker must also be able to work (part-time) for another hiring company. You benefit from flexibility, but so does your employee. Through the ‘allocation function’, the WAB also obliges us to help ‘bring together supply and demand’ in working with agency contracts. We do this with our matching platform (more information below).

Peaks, troughs and risk-free growth

Employers outsource the remuneration of employees for varying reasons. One employer wants to grow with minimum risks, while another wishes to accommodate peaks and troughs in the supply of work. Furthermore, many entrepreneurs are simply glad to outsource their employer’s responsibilities, including all the accompanying duties and risks.

Flexible deployment of employees for up to 5.5 years

As a provider of flexible employment, we can apply the Dutch Collective Agreement for Temporary Employees (‘CAO voor uitzendkrachten’). The CAO stipulates that employees may be deployed flexibly for up to 5.5 years. And that benefits you as the hiring company. Depending on their employment record, employees are assigned to categories in the phase system of the NBBU (Dutch Association of Intermediary Organizations and Temporary Employment Agencies). This is the phase structure:


Duration: 26 weeks

You only pay for the hours worked and can cancel the placement at any time.


Duration: 52 weeks

The employee accrues a pension (for the rest this fase is comparable with fase 1).


Duration: maximum of 4 years

You may offer the employee a fixed-term employment contract on six occasions.


Duration: indefinite

After 5.5 years of flexible employment, the employee is entitled to a permanent contract.

User-friendly digital portal

The matching platform is integrated in our digital portal Pay4me. This portal gives you 24/7 insight into your (flexible) employees online: from contracts and hours worked to payslips and invoices. You can also make your own salary calculations easily in Pay4me. Since the WAB came into force, every employee has been entitled to a transition allowance from the first working day. Our transition allowance indicator shows the current amount of this allowance. Your flex-workers are given their own Pay4me account in which they can approve their hours worked, view their payslips and edit their personal data..

Your employees in good hands

As a legal employer of thousands of freelancers and flex-workers, good employership is very important to us. And that means much more than timely salary payments. We support employees during sick leave and reintegration, offer a pension scheme and lots of collective discounts. Your flex-workers also have unlimited access to our online learning environment called 'Academy for Flex'.

Full or partial health insurance

Tentoo offers two types of agency contracts: one with full health insurance and one with partial health insurance. What type suits you the best?

Full health insurance

You are fully protected if your employees become ill. Tentoo continues salary payments if an employee is absent through illness. In that respect, you have no obligations.

We reserve the holiday allowance, holiday days and public holidays.

This variant is frequently used for employees who work for a hiring company for a fixed number of hours over a longer period.

Partial health insurance

If an employee becomes ill, you are initially responsible for their salary. After 10 (or more) days of sick leave, Tentoo takes over the payment. This means that you do not bear any risks in the event of long-term illness.

We pay the holiday allowance and holiday days in excess of the statutory minimum.

This variant is frequently used for on-call employees, employees who work for few hours for a hiring company and for employees who work for hiring companies for shorter periods. Because you bear no risks, the conversion factor for this variant is more favourable.

Working with agency contracts is not the best solution in every situation. We therefore also offer ‘payment with a payroll contract’. This offers slightly less flexibility but does offer the option of recruiting and selecting employees yourself and ensuring that they work exclusively for you. More information?
